In this action, the plaintiff claimed to have suffered severe back injuries when he fell from a defective scaffold while working on the construction of one of the largest private residences in New York. Plaintiff sued several parties, including our client, a carpentry subcontractor. Plaintiff claimed that our client owned or erected the defective scaffold. Following discovery, we moved for summary judgment on behalf of our client seeking dismissal of plaintiff's claims on the ground that there was no proof that our client owned or erected the scaffold involved in the incident.
