In
United States Fire Insurance Company v. New York Marine and
General Insurance Company, 268 A.D.2d 19 (1st Dept. March
21, 2000), we represented a general liability carrier that declined
coverage to its insured on the ground that the automobile exclusion
in the policy applied. In the underlying accident, the insured
was using one of it trucks to block access to closed tollbooths
on the Atlantic Beach Bridge in Nassau County when a car with
two passengers crashed into the truck. Despite the untraditional
use of the truck in this case, the court agreed with our client's
position that the automobile exclusion in the general liability
policy applied. As a result of this decision, our client did
not have to contribute to settlements totaling $725,000 in connection
with the underlying personal injury claims.
