Leipzig v. Tappan Zee Water Taxi, Supreme Court, Rockland County (May 31, 2000). In this case, our firm represented the Village of Nyack and the Village of Nyack Parking Authority in an action involving numerous claims for personal injury and wrongful death arising out of the capsizing of a water taxi on the Hudson River, which operated out of, and departed from, our clients' marina. The plaintiffs alleged that the Village and Parking Authority were responsible for the operations of the water taxi service as they licensed and leased dock space to the water taxi operator. We were successful in having the case dismissed as the court agreed with our clients' position that they owed no duty to inspect the water taxi or insure that it was safe to carry passengers.
